These Terms of Use ("Terms") govern your access to and use of the SpaGen platform operated by 2633134 Alberta Inc. ("SpaGen", "we", "our", or "us"). By creating an account or using any part of the service, you agree to be bound by these Terms.
1. The Service
SpaGen provides a cloud-based platform for monitoring and automating residential hot tub and spa equipment, including salt chlorination systems, water chemistry sensors, and connected hardware devices ("Service"). Access to the Service requires compatible SpaGen hardware. A limited Demo Mode is also available without an account for evaluation purposes.
2. Account Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
You must be at least 18 years of age to create an account.
3. Free Service
SpaGen is provided free of charge. There are no subscription fees, trial periods, or paid tiers. We reserve the right to introduce optional paid features in the future, and will provide reasonable notice before doing so.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Reverse-engineer, decompile, or disassemble any portion of the Service
- Use the Service to transmit malicious code, spam, or unsolicited communications
- Resell or commercially redistribute access to the Service without written permission
5. User-Submitted Content
When you upload photos (such as water chemistry test strip images), you grant SpaGen a limited licence to store and process those images solely for the purpose of providing the Service to you. You retain ownership of any content you upload. We do not use your photos for any purpose beyond analyzing your water chemistry results.
6. Hardware & Installation
SpaGen hardware is sold separately through laspas.ca. Installation of electrical components must comply with applicable local electrical codes. SpaGen is not responsible for damage arising from improper installation. We strongly recommend consulting a licensed electrician if you are unsure.
7. Intellectual Property
All content, software, and materials on the SpaGen platform are the property of 2633134 Alberta Inc. or its licensors and are protected by Canadian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
8. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service. Automated control of spa equipment (pumps, dosing, etc.) is provided as a convenience tool — you remain responsible for the safe operation and maintenance of your equipment.
9. Limitation of Liability
To the maximum extent permitted by applicable law, 2633134 Alberta Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to equipment damage, water quality issues, or data loss.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account and all associated data at any time directly within the app under Settings > Account > Delete Account, or by contacting us at [email protected].
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta.
12. Changes to These Terms
We may revise these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date and may notify you by email. Continued use of the Service after changes constitutes your acceptance.
